Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between Answer Genomics Private Limited ("NuGenomics", "we", "us"), registered at 45/3, Gopala Krishna Complex, Residency Road, Opp. MG Road, Museum Road, Bangalore North, Bangalore 560025, Karnataka, India, and the person or organisation that creates an account on our platform ("you", "your", "Customer"). By creating an account, purchasing Credits or generating a Report, you accept these Terms. If you do not accept them, please do not use the Service.

1. Definitions

  • Service — the NuGenomics platform, which reads laboratory blood-test documents you upload and generates a structured health report.
  • Patient— the individual whose laboratory results appear in a document you upload. The Patient may or may not be you.
  • Report— the health report document produced by the Service.
  • Credits— prepaid balance in your account wallet, used to pay for Reports.

2. Eligibility and account

You must be at least 18 years old and, where you register on behalf of an organisation, authorised to bind it. You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for all activity under your account. Please notify us immediately of any unauthorised use.

The Service is intended for use by healthcare providers, diagnostic and wellness businesses, and professionals in the course of their work. It is not a consumer self-diagnosis product.

3. Authority and Patient consent

You represent and warrant that, for every laboratory report or health record you upload, you have a lawful basis and the documented consent of the Patient (or of a parent or lawful guardian, where the Patient is a minor) to share that information with us for the purpose of generating a Report, and that you have informed the Patient that the analysis is performed by automated means.

As between you and us, you determine the purpose and means of processing Patient information; we process it on your instructions in order to provide the Service. You agree to indemnify and hold us harmless against any claim, demand, penalty or proceeding arising out of your uploading or sharing information without the authority described in this clause.

4. The Report is not medical advice

Reports are informational and preventive-wellness outputs generated from the data you supply. They are not a medical diagnosis, not medical advice, not a prescription, and not a medical device. No doctor-patient relationship is created between NuGenomics and you or any Patient. A Report is not a substitute for consultation with a qualified registered medical practitioner, who remains solely responsible for clinical decisions.

Where a Report indicates a result that may require urgent attention, the Patient should seek medical care immediately and must not wait for, or rely upon, any further Report. In a medical emergency, contact emergency services or the nearest hospital at once.

5. Automated processing, and your duty to review

Reports are produced by automated systems, including cloud-based artificial intelligence services that read your uploaded documents and generate explanatory text. Automated reading of documents is not perfect: values may be missed, misread or omitted, particularly where a document is handwritten, scanned at low quality, or laid out unusually.

You are responsible for checking the extracted values in the review step before generating a Report, and for reviewing the completed Report before sharing it with a Patient. Where a Report omits a marker or a section, that reflects the data available in the document you supplied.

6. Credits, pricing and payment

  • Reports are paid for with Credits, purchased in advance through our payment gateway partner.
  • The standard price is ₹200per Report and the minimum wallet recharge is ₹5,000. Prices are inclusive of applicable GST (currently 18%).
  • Credits are denominated in Indian Rupees, are non-transferable, carry no interest, have no cash value and are non-refundable except as set out in our Refund & Cancellation Policy.
  • The applicable amount is deducted when a Report is generated. If generation fails for a technical reason attributable to us, the deduction is reversed automatically.
  • A Report you disagree with, or one that is limited because the uploaded document contained few results, is not a failed Report.
  • We may revise prices on notice. Credits already purchased are honoured at the price in effect when they were bought.
  • Card and payment details are collected and processed entirely by our payment gateway partner. We do not receive or store card details.

7. Acceptable use

You must not:

  • upload documents relating to a person whose consent you do not have;
  • upload material that is unlawful, or that you are not entitled to share;
  • resell, sublicense or white-label the Service except under a separate written reseller agreement with us;
  • attempt to access another account, probe or interfere with the Service, circumvent usage limits, or use automated means to extract data at scale;
  • copy, decompile or reverse-engineer any part of the Service, or use its outputs to build a competing product;
  • present a Report as a diagnosis, or represent it as issued or endorsed by a medical practitioner.

8. Intellectual property

The Service, including its analytical logic, scoring methods, report templates and content, belongs to us and is protected by law. You receive a limited, non-exclusive, non-transferable right to use the Service and to use the Reports you generate for your own business and patient-care purposes. You retain all rights in the documents and data you upload, and grant us the rights necessary to process them in order to provide the Service.

9. Data protection

Our handling of personal information, including health information, is described in our Privacy Policy, which forms part of these Terms.

10. Availability

We aim to keep the Service available but do not warrant uninterrupted or error-free operation. We may suspend the Service for maintenance, or modify or discontinue features, and will give reasonable notice of material changes where practicable.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the total fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special or consequential loss, loss of profits, loss of data, or for any clinical decision, diagnosis, treatment, outcome or omission based on or influenced by a Report. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your account where you breach these Terms, where we reasonably suspect fraud, a payment reversal or misuse, or where required by law. On termination for breach or fraud, unused Credits may be forfeited. On termination for any other reason, unused Credits are treated in accordance with the Refund & Cancellation Policy.

13. Changes to these Terms

We may amend these Terms. The current version and its effective date are shown at the top of this page. Material changes will be notified to you, and continued use of the Service after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of India. The courts at Bengaluru shall have exclusive jurisdiction. Before commencing proceedings, the parties will attempt in good faith to resolve any dispute by discussion, beginning with a written notice to the contact address below.
